Fusion SMS Terms and Conditions

These Fusion SMS Terms and Conditions (“SMS Terms”) govern the text messaging program offered by Millennium Digital Technologies, LLC, doing business as Millennium Digital Technologies (“MDTech,” “Company,” “we,” “us,” or “our”), through the Fusion application.

When you select “Send Verification Code,” you request one automated SMS message from MDTech Fusion containing a code to verify the mobile number you provided. If you select “Resend Code,” each selection requests one additional verification message. Message and data rates may apply. Requesting or completing mobile-number verification does not enroll you in recurring Fusion SMS messages.

After verification, you may enroll in Fusion SMS by actively selecting a separate, optional SMS consent checkbox. The checkbox is unchecked by default, and the “Enable SMS and Continue” action remains unavailable until you select it. Fusion SMS is enabled only after you select the checkbox and choose “Enable SMS and Continue.” By doing so, you agree to these SMS Terms and consent to receive the messages described below.

Enrollment in Fusion SMS is optional and is not required to access or use Fusion. SMS-dependent authentication, notification, monitoring, or alert features will not be available unless you enroll.

These SMS Terms supplement the Fusion Application Terms and Conditions. If there is a conflict, these SMS Terms control only with respect to Fusion SMS communications.

Public documentation and screenshots of the authenticated Fusion SMS enrollment process are provided in Section 2.1 below.

1. Program Name and Operator

Unless we expressly state otherwise, Fusion SMS is currently available to authorized users with supported mobile numbers in the United States. Availability may vary by wireless carrier, device, and location.

2. Eligibility and Enrollment

Fusion SMS is available only to authorized Fusion users.

To enroll, you must provide a valid supported U.S. mobile number, complete the required verification process, and affirmatively enable SMS communications in your Fusion account settings.

By enrolling, you represent that:

  • You are the subscriber, account holder, or customary authorized user of the mobile number.
  • You are authorized to receive messages at that number.
  • The information you provide is accurate and current.
  • You consent to receive automated transactional and informational SMS messages from MDTech through Fusion.

Your consent applies only to MDTech and the Fusion SMS program. Consent is not transferable to another business, affiliate, campaign, or sender.

2.1 Public Documentation of the Fusion SMS Opt-In Process

Actual enrollment in Fusion SMS occurs inside the authenticated Fusion application. The screenshots below publicly document the complete user enrollment and consent process for telecommunications carriers, messaging providers, and campaign reviewers.

The screenshots use fictional test information and do not contain customer data. This public webpage does not collect mobile numbers or enroll website visitors in Fusion SMS.

Step 1: Enter a Mobile Number and Request a Verification Code

An authorized user signs in to Fusion, opens Account > Communication Settings, and enters a supported United States mobile telephone number.

By selecting “Send Verification Code,” the user requests one automated SMS message from MDTech Fusion containing a verification code. Message and data rates may apply. Requesting the code does not enroll the user in recurring Fusion SMS messages.

Step 2: Verify Control of the Mobile Number

The user enters the one-time verification code received at the provided mobile number and selects “Verify Number.”

Selecting “Resend Code” requests one additional verification SMS. Completing mobile-number verification confirms control of the number but does not enable recurring Fusion SMS. SMS remains off until the user completes the separate consent step.

Step 3: Provide Separate, Optional SMS Consent

After the mobile number is successfully verified, Fusion presents a dedicated SMS consent checkbox.

The checkbox is unchecked by default and is separate from acceptance of the Fusion Application Terms and Conditions or any general privacy notice. The user must actively select the checkbox before the “Enable SMS and Continue” action becomes available.

The user may instead select “Keep SMS Off” and continue using Fusion without enrolling in recurring SMS communications.

The disclosure displayed immediately adjacent to the checkbox states:

In the Fusion interface, “Fusion SMS Terms and Conditions” and “Fusion SMS Privacy Policy” are direct links to MDTech’s publicly accessible policy pages.

Step 4: Review and Save SMS Notification Preferences

After actively selecting the SMS consent checkbox and choosing “Enable SMS and Continue,” the user is presented with the available Fusion SMS notification categories.

The user can review and adjust the master Fusion SMS setting and the available notification categories, which may include:

  • Account and security notifications.
  • Service and workflow updates.
  • Monitoring alerts for authorized companies, locations, or devices.

The user selects “Save SMS Preferences” to save any changes. The user may subsequently disable all Fusion SMS messages through the master Fusion SMS control or reply STOP to a received message.

Users may reply HELP for assistance. Additional program information appears in the remaining sections of these Fusion SMS Terms and Conditions and in the Fusion SMS Privacy Policy.

3. Types of Messages

Fusion SMS may send:

  • Multifactor authentication and verification codes.
  • Account login and security notifications.
  • Password, credential, or account-status notifications.
  • Service and workflow updates.
  • Operational notifications.
  • Monitoring alerts concerning companies, locations, or devices you are authorized to access.
  • Enrollment, opt-out, HELP, and customer-support messages.

Some notifications may be generated by your activity, your organization’s authorized administrators, notification subscriptions enabled in Fusion, configured workflows, device conditions, or monitoring rules.

Some Fusion SMS messages may include first-party links to relevant Fusion pages or the MDTech Fusion Secure Access gateway. Messages may also include MDTech customer-support contact information, including telephone numbers. Access to linked Fusion information may require authentication and appropriate account permissions.

Fusion SMS does not send advertising, sales promotions, affiliate marketing, lead-generation messages, or third-party marketing.

4. Message Frequency

Message frequency varies based on your account activity, security events, notification subscriptions enabled in Fusion, configured workflows, monitoring conditions, and other service activity.

Periods of increased activity or alert conditions may result in multiple messages. Periods with no relevant activity may result in no messages.

5. Message and Data Rates

Message and data rates may apply.

Your wireless carrier may charge you for sending or receiving SMS messages according to your wireless plan. You are responsible for any charges imposed by your carrier.

6. How to Opt Out

You may opt out at any time by replying STOP to a Fusion SMS message.

After you opt out, you may receive one final message confirming that your request was processed. We will not send further Fusion SMS messages to that mobile number unless you subsequently re-enroll.

You may also disable SMS communications through your Fusion account settings.

Opting out of Fusion SMS may prevent you from receiving SMS-based multifactor authentication codes, account and security messages, workflow updates, and monitoring alerts. You are responsible for selecting another available authentication or notification method where necessary.

To resume Fusion SMS after opting out by reply, you must first reply START or UNSTOP to remove the messaging block. You must then sign in to Fusion, re-enable SMS in your account settings, and complete any required mobile-number verification and consent process. Replying START or UNSTOP alone does not provide initial consent, enroll a new user, or restore Fusion notification subscriptions.

8. Mobile Number Changes

You must keep your mobile number current in Fusion.

If you change, transfer, deactivate, or relinquish your mobile number, remove or update it in Fusion before the change takes effect. You must not enroll a number that belongs to another person without authorization.

We may suspend SMS delivery when we believe a number has been reassigned, deactivated, entered incorrectly, or used without authorization.

9. Delivery and Availability

SMS delivery depends on mobile carriers, networks, devices, service providers, and other systems outside our control. Messages may be delayed, filtered, duplicated, or undelivered.

Neither MDTech nor any participating wireless carrier guarantees that a message will be delivered or delivered within a particular period. Wireless carriers are not liable for delayed or undelivered messages.

You should not rely on SMS as the sole method for receiving time-sensitive, safety-critical, or emergency information. Continue to use Fusion, your organization’s established procedures, and appropriate emergency services as applicable.

10. Privacy

Our collection and use of information in connection with Fusion SMS are governed by the Fusion SMS Privacy Policy available at:

We do not sell, rent, or share mobile telephone numbers, SMS opt-in data, or SMS consent with third parties or affiliates for their marketing or promotional purposes.

11. Changes to the Program or These Terms

We may modify, suspend, or discontinue all or part of Fusion SMS. We may also update these SMS Terms to reflect changes in the program, legal requirements, carrier rules, or our business practices.

The “Last Updated” date will identify the latest revision. We will provide additional notice or obtain additional consent when required before materially expanding the categories of SMS messages you receive.
